The Brussels, Walloon and Flemish governments have announced the scrapping of the temporary measure restricting the indexation of rents on the basis of the PEB (Energy Performance of Buildings) certificate.
The restrictions on rent indexation for accommodations with PEBs at level D, E, F or G (75% or 50% of full indexation or indexation not permitted) come to an end on 1 November 2023 in Wallonia, on 13 October in Brussels and on 1 October 2023 in Flanders. Landlords will once again be able to adjust the rent for their accommodations, even if they hold a PEB certificate that shows low energy performance.
To avoid “double indexation”, specific calculation methods with correction factors have been established. For more details on these formulas, use the rent calculator on the Statbel website.
This decision to end the restriction on rent indexation is likely to have a significant impact on the rental market and on tenants. It marks a change in the regions’ housing policy, and developments in the coming months will need to be monitored to assess the actual effect on rents and the property sector in general.
